THESE ARE THE TERMS OF SERVICE which govern your hosting transaction. They explain what we provide and what we do not provide.Please read carefully to avoid unneccessary problems.

Own Domain: The order form should be filled correctly with all the required fields and you should own your domain name, or have admin/registrant rights to change Name Servers on your domain.

Unacceptable or Socially Inappropriate Content: We reserve the right to refuse Domain Hosting Services for any reason or whatever reason we determine it to be "Unsuitable". 

Unsuitable sites include, for example, to the below sites and TERMINATE it immediately without NOTICE.

• include, promote, or link to SEXUALLY EXPLICIT material eg ADULT sites. 
• include, promote, or link to violence or illegal activities. 
  
• include, promote, or link to use of drugs, beer/wine or use of cigarettes etc. 
  
• include, promote, or link to material that promotes or depicts discrimination based on sexual orientation, race, gender, religion, national origin, physical or mental disability, or age.
  include, promote, or link to material which violate intellectual property rights or material of such nature. 
  
• Warez sites and also warez download linking is strictly prohibited on our servers. Also hacking sites or sites hosting hacking codes or tools are also absolutely not allowed to host on our servers. 
  
• Using our servers to SEND SPAM emails is strictly prohibited. Penalty Rs.3500 ($75) for each abuse.
  

  As you should be aware, spamming is not something that can be warned and we do the best practised is the suspended for investigation and if spam abuse received from spam monitoring network such as spamcorp, UCEprotect or blacklist RBL network, then we will terminate the user immediately. (This type of cases will not have a chance to appeal at all as it considered as serious violation)

• We DO NOT allow Large Video websites, uploading / downloading of movies, tv shows, gaming websites or sites used for continuous uploading / downloading large files for Videos, Audios and other similar media.
  
• We DO NOT allow any free domains to be hosted on our servers like .co.cc etc
  
• Also we will terminate WITHOUT NOTICE any sites involved directly or indirectly with phishing activities (“Phishing” is a form of Internet fraud that aims to steal valuable information such as credit cards, social security numbers, user IDs and passwords). Proper care should be taken not to handover your cPanel or WHM login details, passwords to any authorized persons who can do illegal activities on your account for which you will be held responsible.

Further, as a cPanel customer or if you are holding a reseller account, you are requested to further check all your existing customer accounts and verify each of them.  Also you should check each new customer properly and verify them (domain whois, address, tel and contact details etc) and make them aware of our terms and conditions (as given here) so that they know what is allowed and what is not.

This will prevent further issues regarding your account suspension or termination.
Anyone how caught on hosting any of the above sites will subject to immediate
ACCOUNT TERMINATION WITHOUT NOTICE.

Penalty: Anyone found not following the above hosting terms will be penalized minimum Rs.3500/- ($75) upto maximum Rs.10,000/- and invoiced and should be paid immediately. This is to ensure that genuine users are not faced with unnecessary server abuse problems due to a few rare individuals who abuse our server resources and cause server problems.

No Refund Policy: We are providing 30-Day MoneyBack Guarantee on all our plans to check out all our features, support etc. At any time after 30 Days should you decide not to continue further, you can do so but there will be absolutely NO REFUND. Also if your account is NOT following the above ACCEPTABLE USE POLICY or not following our RESOURCE ABUSE POLICY guidelines, and we are forced to move this website out of our server, then also there will be NO REFUND.

Idle Accounts: We reserve the right to terminate hosting services to any individual, company, organization having their hosting accounts lying idle with NO pages Uploaded or NO emails send/receive or NO Logging or NO activity for 60 days consecutively. Their should be some activity on your Web hosting account at least once every 60 days.

Right of Refusal: We reserve the right to refuse/terminate hosting services to any individual, company, organization, or entity for any or whatsoever reason.

Mail Server Policy: Any sites that engage in excessive use of the Mail Server are prone to immediate termination without notice. Excessive use is defined as any process or procedure which overtaxes the Mail Server resulting in other clients being unable to access the Mail Server to send and receive normal email communications. Prolonged and repeated mail abuse will result in a users SMTP priveledges being revoked without notice. Currently our server is set to send 50 emails each hour on each account which is more than enough for 99% of our customers.

Spam Policy: We do not practice, participate in, nor condone SPAM of any sort. Offenders of SPAM will be notified by us to cease and desist such activities. Failure to comply will result in immediate termination of mail services without refund and a minimum penalty of Rs.3500 ($75) for each abuse. The negligence of a single domain residing on our servers could result in we being placed on an anti-spam list. Should we be placed on the anti-spam list, every domain e-mail service will be affected and blocked. We wish to protect our customers of this problem and for this reason, we will remain intolerant of SPAM.

Purchasing Service(s): To begin the purchasing process, you must print, read, sign and email this agreement to us at within 30 days of completion of the online contract via our Site. Failure to send this to us irrevocably waives all client priveleges.

Policies and Pricing: Customers who purchase AMCwebhost service(s) will be considered customers. All company rules, policies and operating procedures concerning customer orders, customer service and service sales will apply to these customers. We reserve the right to change our policies and operating procedures at any time. For example, we will determine pricing schedule for services sold by us which may vary from time to time.

Payment of Service(s): AMCwebhost accepts payment in the form of Credit Card (Mastercard, Visa), personal or company check or pay order or Demand draft. Credit Card numbers will be verified before transactions occur. Upon receipt of payment, you will receive an order confirmation via an e-mail message outlining other policies and procedures.

Service Agreement: We agree to process services purchased by customers. We reserve the right to reject orders that do not comply with the necessary requirements that we may establish from time to time. We will be responsible for all aspects of service processing, customer support and payment processing and we agree to handle all customer service requests generated at the order form. After the completion of the setup of your services, ALL service requests must be made via the Request for Service Form. This is necessary to be sure all requests for assistance are met in a timely, efficient manner.

Customer Service and Our Service Warranty: We agree to provide technical assistance for services you purchased where there is a technical problem as the result of the setup or configuration of your Internet service(s). We will resolve these problems and provide e-mail response as to the solution within 1-2 business days providing you follow the service policies and procedures outlined in your order confirmation document. We will provide answers to frequently asked questions or problems which will be posted on our site under the FAQ link. At all times, we want our customers to feel satisfied. We will provide the best possible service to you. Should you find a problem with the setup of your Internet service(s) as it is going on you are responsible to contact AMCwebhost as outlined in your order confirmation document.

We disclaim all liability for development and maintenance of Your Site that has not been directly *purchased from AMCwebhost. You will compensate and hold us harmless from all claims, damages and expenses (including, without limitation, attorneys' fees) relating to the development and maintenance and contents of Your Site.

Limitation of Liability: We disclaim liability for any indirect, special or consequential damages, arising in connection with this Agreement or Service(s), even if we have been advised of the possibility of such damages.

Term of this Agreement and Termination:The duration of this Agreement will begin with our receipt of your signed Agreement and will end when terminated by either party. Either party may terminate this Agreement at any time, with just cause, by giving the other party written notice of termination.

When you sign up the order form on our home page, and "Tick" and select "Yes", YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PURCHASING AMCWebhost, INC. SERVICE(S) AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
